Parole revocation hearing????????

Let me start by saying this is the 2nd time i have done this and for some reason the last one is gone. I am still very new to this. But i need help from someone that is a little more educated in this field.
My boyfriend was wrongfully charged and arrested for simple domestic assault. A family dispute happend in our home,and an outsider that was heavily under the influence of prescription drugs called the police to our home. When the police arrived they found that my boyfriend was on parole for theft over 10,000 and aggr. burglary. He was taken into custody and released on bail the next day. After reporting the incident to his PO a warrant was issued for a violation of his parole. Pending a revocation hearing. The court date for the SDA charge is set for November 4,2008. Since i am the alleged victim the charges will be dropped. What should we expect to happen during the revocation hearing. His experation date is 9/11/2009. Should he have to serve the remainder of his sentence.:confused:

You can keep reposting all you want , and slice and dice it differently each time , but your answers will be the same .

Who said the charges of DV will be dropped ?

Charges are not dropped until they are dropped .

Police do not make it a habit of arresting persons for DV , just because there's a 911 call .

IF , the charges are dropped or are confirmed to be dropped and that info can be provided at the parole violation hearing , the Judge might give him the benefit of the doubt and not find him in violation .

Your excuse the neighbor was heavily medicated , has noting to do with what they saw or thought they seen or heard , nor what the officer(s) observed .

Why do you not include what the DV was all about , instead of avoiding that aspect , then saying " the neighbor " .

Early that morning while my boyfriend was at work and my child should have been at school i had to call the county Sheriff to assist with my child refusing to attend school. The officers gave her a police escort to school. That evening my child refused to hang up the telephone when asked to do so. So having had several problems with the child i got a belt and was going to handle things the best way i know how.(SPARE THE ROD SPOIL THE CHILD!!!} My boyfriend then came in from work and pushed me away from my UNRULY child, resulting in me falling over a basket and landing in the bathroom. His mother not a nieghbor came in upset with all 3 of us and ran home and called the police stating i had in fact been assaulted. The officer then came to our residence and saw that my boyfriend was not only on parole but a violent offender. After talking with the officer he turned and put him in handcuffs and took him away, not believing anything i said. So now we are here looking for answers.

OMFG! You called the police to parent your child because you are incapable of parenting yourself? And you wanted to abuse your child?

You need to call the Department of Child Services or Child Protective Services and have your child placed into a home with sane parents. You should not be allowed to have children

Let me start by saying the police dept in my community told me MONTHS ago if i did not in fact discipline my child i would be breaking the law. I have raised this child by myself for years now.Her father has passed almost 2 years ago to the date. So if spanking a child is a form of abuse or neglect on my part as a parent by all means judge me the way you will. But i do pray that when your teen kicks your ass for lack of discipline, Someone is there to kick you out from under them.

Taking a belt to a 12 year old is NOT discipline. It is assault. Period. It is NOT a spanking. It is child abuse. I would suggest you take a parenting course to learn how to control your unruly child without beating her with a belt. Therapy for both of you would be advisable as well. Your daughter may be acting out due to the loss of her father...a beating is NOT the answer.

BTW: My children have NEVER been whipped, beaten, slapped or otherwise abused by either their father or I. I have NEVER had issues with either.

Ditto from me. I've never had to beat, whip, spank, or hit my children. They are now 21 and almost 18, and I've never had issues with them. It's called parenting. Unfortunately for the child of the OP, she has never learned to be a parent.

That's not a spanking. That's a whoopin'. It's called beating a child aka child abuse.

My parents whipped me with a belt when I was growing up. You know what I remember? Not a thing as to WHY I was whipped, only that my parents felt it completely normal to physically harm me. I STILL have issues with it today. YOU DON'T BEAT YOUR KIDS. If you have such a lack of control over your 12 year old child, that's not a reflection or indication that your child is the problem. YOU are the problem. The fact that you would be involved in a relationship with someone who has the history of your boyfriend (recent history, at that...he's still on parole) while trying to raise a vulnerable little girl who recently lost her father speaks volumes.

I gotta side with the panel here.

The moment you start choosing the proper weapon to beat your child with, you have already lost the fight.

Further, it doesn't surprise me in the least that you wouldn't see being thrown across the room as abuse.

Thank God an outsider got involved.

Make sure you show the judge the belt you use to beat your children.

The poster came back multiple times , rearranging the stories , hoping to receive an answer that was suitable .

I gave an accurate response .

The folks at lawyers.com will not tell the poster for a fact , the person will not be violated .
