So,for a simple misdeamonor the prosecutor is willing to dismiss the charge but he is reluctant to do so because the dismissal may be used by me to file
a wrongful termination suit against my former employer. I say the decision to
terminate was based upon the arrest only, so the final disposition of the case shouldn't enter into any reasoning he has recommending a dismissal.

Can the prosecutor really say this in open court in front of the judge at a pretrial hearing??
