I am in VA. I have a friend who was convicted of a felony last year and was sentenced to 2 years, with 18 months suspended. He was on probation, but was just violated for not paying restitution. He had six months of his original time revoked. In VA, an inmate is required to serve 50% of his time for misdemeanors and 85% for felonies. My question is - is his probation violation a misdemeanor, or is it considered a felony, since his original charge was a felony?
