rape 1st degree, plead to harassment, new information


I am from Alabama, and 3 years ago, i had a 16 year old co worker to claim that I raped her on two different occasions in the bathroom at work. I was arrested and charged with 1 count of 1st degree rape. the first offer was 2nd degree assault, which we turned down. during the arraignment hearing, they offered harassment, class c misdemeanor, 90 days suspended sentence, 2 years unsupervised probation during which i would have no contact with the girl, and pay a fine of around $300. I never raped the girl, but I did have a sexual relationship with her, and i was 25 at the time. she is now 19. I recently looked into joining the army, and because i was arrested for a major crime, they are not taking anyone with major crime violations, no matter the outcome. well, my probation was lifted, and I emailed the girl on myspace and asked her why she wanted to try and ruin my life. she responded to me, and told me "it was actually my mom who did that. i guess she didnt like the idea of a 16 year old doing it with a guy older then 18... but i am sorry about it" (i still have this email). I accepted her apology and asked her to tell the truth.

my question. is there anyway that my record could be cleared from this if she comes forward and tells the truth?

Cleared of what? Sounds like you were convicted correctly. It also sounds like you got a very good deal. Change in her testimony now will change nothing about the conviction. You had sex with an under age girl and only got convicted of harassment. I think to re-visit that would be a waste of time.

in the state of Alabama the legal age of consent is 16. I am in no way saying that what I did was right, and God has taught me that. Even in the detective's narrative, the girls mother asked him if it was consensual, would their have been any laws broken, and he said no.

The reason to revisit it, is that the girl even said that it was her mom that pushed this and that she lied about it. I knew myself that she lied about it, but she has even said it to me, and says that she will go forward to tell the truth. The reason I would like to be cleared of this totally is to enlist in the army. With the current economy, they are not taking anyone with major criminal offenses with other adverse actions. If i was cleared of it all together, then they would accept me.
