Set up and now facing charges.. Help..


What is the name of your state (only U.S. law)? Nebraska

Yesterday, I was accused of breaking a mans windshield in his car. (Which I got a phone call from the police today, not knowing anything of the situation except what I had heard happen a few hours before hand from a friend). I went to the police station as they interrogated and questioned me.. Now I have a court date set with charges of "Criminal Mischief" & "3rd Degree Assault?". Not knowing any of this happen nor being around when it happen, The blame is being placed on me by a man and a supposed "witness". What should I do & What am I looking at if they do not find the real criminal?

where were you when this incident actually occured?

Home asleep.

The kill part is the man is my friends ex boyfriend.. Which I think the set up is to get me out of the way so he can try to get back around her without me being around (she doesnt want him around).

This is pretty serious.

and there is nobody to testify to that?

who is the witness?

I have a line of people knowing I had nothing to do with it.

His only witness would be his friend (which from what the officer said was in the back seat while the windshield was busted in)

I understand the "Criminal Mischief" for them breaking his windshield, but I read the report and there was nothing about assault..

So I have to go to court basically expecting the worst based on there statements.

It is common for police to charge you with extra violations to leverage a plea agreement. With the assault they can make your situation sound bad if found guilty of all charges at trial. You need a copy of the police report to determine where you stand and if you were charged correctly. Obviously, you are not being charged correctly if you have no knowledge of the situation. Although you can still find out with the report if you were charged correctly based on the info. they received. Can you afford an attorney or are you going to use the p.d. If I was innocent and being accused I would go to trial. Goodluck.
