What is the name of your state? Pennsylvania (Fayette County)
My boyfriend is incarcerated on both state and federal charges. He is in the process of trying to file a 2nd appeal with the state conviction and has had Public Defender working on it for him. The public defender submitted an appeal that was denied because of the P/D's failure to cite any reference to the evidence in the transcripts. My boyfriend wishes to submit a second appeal citing all the issues he knows he has as well as the referenced evidence on the transcripts. He has been deemed by the judge to be in forma pauperis. The Public defender's response to his request for his transcripts states that he must pay for them and get them from the court stenographer. The cost for these transcripts is outrageous at $780.00 ($1.50/page) How can a poor person fight for his freedom when he doesn't have the advantage of money? What is his recourse, if any? Shouldn't he have a legal right to HIS transcripts?? Any suggestions would be appreciated. Thank you.

First off the cost is not outrageous. It's reasonable whether you believe it or not.

Now your boyfriend can file with the court and ask to waive the fees. this is a separate issue than the determination that a pd is necessary.
