Getting license back additional info

Just thought I'd add that his .1 was taken with a breath wand, they just wave it in the car. It's a Japanes thing and I don't know if it's more sensative or not. He also said he ate 5 hours earlier and had 3 Beams. He's attended all the classes they asked for and has never had a DUI. Thanks for any help
