This is a courtesy inquiry for a friend.

Does anyone here know of a source for Michigan survival statutes in regards to a deceased spouses debts and his estate ? She needs to know if there are specific laws that would protect the survivor from liability.

If your friend lives in Michigan, she could probably find the state laws/codebooks in any public library or university library.

The website www.gouldlaw.com/michiganprobatecode.html offers a 300 page book with the probate law in it for $16.00 and she might also find someone at this website, www.icle.org/PracticeAreas/probate.cfm, able to answer her request to see if it is available online.

It would be much wiser to visit a probate attorney in person to get the simplified, quicker answer to her question. The spouse has almost no liability for the decedent's debts, but you didn't mention how much the estate was worth or how much the debts are. Someone who tries to interpret the law on their own, without professional help, can sometimes get confused about the true meaning.
