A few days ago, my husband and I used Chevron Oil Stop Service for an Oil change. They checked the car and convinced us that the transmission needed to have the fluid changed for an extra $33. So we agreed. About an hour and half later, the gear started to slip and the car became undrivable. We called the tow truck and brought it back to the Chevron but it was already closed. The next day we went back there and talked to the manager of the place, and we took the car to the transmission shop where he recommended so they could diagnose the cause. With one look, the tech said that the Chevron should have changed the filter and flush the system, because we have about 105,000 miles on it. He said that he had seen about 6 cars a month with the same problem. Our transmission was fried. He needed to look further to see exactly what caused it.

The argument of the Chevron Oil Stop is that we have an old transmission, and usually it needs work around 80,000 miles. The manager even implied that we had the service AFTER we found the problem to the transmission, and tried to blame it on THEM. Now it is no way of telling the problem occurred before or after the service.

Our argument is that we had no prior problem with it what so ever. We had a few usual problems came with the miles, but never on the transmission. No signs of trouble untill the day we went to the Oil Stop. Perhaps we have evidences from prior mechanic reports. Beside, many of our friends who knows a little bit of mechanics all said that it is a standard procedure to change the filter and flush the system, which they neglected. They don't even offer those services here. All they did was added the new fluid to the old system, which caused the debris in it to be stirred and clogged the system. EVEN the transmission specialist stated that.

Well the Oil Stop Manger and the transmission place seem to be in good term, and the transmission tech wouldn't give us a straight answer as to who's fault it is.

I don't know what to do....they have partially agreed to pay the damage but they don't want to cover the wole thing. They said that the transmission was already old so they can only cover the partial cost, but we don't have any extra money to pay for this damage. The car won't run on a "Partial" transmission. We made many phone calls but they wouldn't call us back. Meanwhile, we are renting a car, and we are running out of money because of this problem. What is the least expensive option for us to get our money back? Do we have a right to sue them for the rented car, Tow Truck etc?? Can we sue them for the lost time we spent waiting for the calls that never came?
