What is the name of your state? Louisiana

My mother in law passed there has been nothing filed yet. My husband's nephew applied and received two credit cards in his Grandmothers name after her death. He then maxed them out.Of course no payments were made. What are our choices for recourse. He also took her car to Texas where he lives and did not make the payments as agreed. The car was repossessed for non-payment is there anything we can do?

Contact the credit card companies to inform them about the nephew's fraudulent applications and then they will begin a procedure to investigate and file charges against him.

Did your mother-in-law have a will and did the will name someone to serve as executor? If so, then the executor needs to file the will so that he can receive the papers giving him/her the legal authority to start claiming assets and handling estate affairs. If there was no will, then someone in the family needs to file paperwork to become the administrator or hire a probate attorney to do it.

If there is enough money in the estate to continue paying the car payment, then the executor will need to start doing that (making payments) to get the car back.

What was the nephew thinking? Did he think the estate would pay for everything, or did he believe nobody could collect on the charges since Grandma passed away? He is in deep doodoo and could go to prison for theft - maybe grand theft.
