What is the name of your state? Indiana how can i get a judgement in small claims court vacated due to financial hardship that a garnishment is causing?
You would have to file a Motion to Vacate with the original court. They would then set a hearing date where you would have the opportunity to argue why the judgment should be vacated. Problem is... hardship is not a sufficient reason.
The court would only vacate if there were an error in the legal process... most often improper service.
