What is the name of your state? What is the name of your state? Virginia

My Husband's ex-wife continues to use her "married" name. Their 2 children were removed from her home in 1997 (ST of VA) and my husband and I have had custody since (ST of CT). What legal action, if any, can we take to relinquish her married name? If the children lived with her, it would be a different story. Thanks.

My response:

There's nothing you can do, unless she's doing something otherwise illegal that involves you or your husband. Notwithstanding that, she can call herself anything she wants. 99% of surnames are not unique, so the chances that someone else bearing your husband's surname in this country, or perhaps the world, is great.

I thank you for your quick response. I guess we'll have to wait for her to accept a marriage proposal...if anyone dares.
