Hi. My husband and I have no debts or assets together. On the Petition I've checked the 'There are no such assets or debts subject to disposition by the court in this proceeding' box.

Do I still need to serve Preliminary Declaration of Disclosure forms?

These things have an ugly way of coming back to haunt you. Relevant at this time or not, file it.

My response:

The Preliminary Declaration of Disclosure is mandatory and nonwaivable [Ca Fam § 2104] But, have no fear - - the Filing Clerk would have caught your omission, and would have rejected your Petition, and given it back to you with a "Rejection" sheet, telling you what you failed to include; i.e., the Preliminary Declaration of Disclosure.
