Hi.

A friend of mine is currently going through what looks like it will be a very ugly separation and divorce. All she wants really is custody of their son. Her soon to be ex has been wielding this child as a weapon to inflict mental torment on my friend. He keeps threatening to try to get custody of their 17 month old child. He makes petty demands, etc., knowing how to push her buttons. He calls her frequently at work and home.

She wants out ASAP - but is very scared of his threats.

Now - he wants to be the plaintiff in the divorce, stating that she is at fault. But it's happening because he has been cheating on her with a former coworker of his since before the child they have was conceived.

Will it matter who is plaintiff? Would she be putting herself at a gross disadvantage to let him have his way in this?

They have no real assets and recently went through bankruptcy - so no real big debts either.
