Hi, I hope someone can help. I went to an adult bookstore on saturday nite around 2:15 am. It is one that I have frequented before. I got change and went to the back where the arcade booths are. I proceeded to go into a booth and came out after my time was up. I then went into another booth, locked the door and put a dollar in, sat down and lit a cig. A short time later my door was opened from the outside. I am aware that that is possible. The guy shut my door and I relocked it. This bookstore is well known for being "cruisy" for gay men. I am one as well. I had seen the guy that opened my door on other occasions but had never had any type of communication with him or his friend who he came with on all occasions. A short time later my door was opened up again by the friend of the first guy.I guess they were trying to see if I was doing anything with the person in the next booth. At that time I was coming out of the booth. both the 1st and 2nd guy were standing by my booth leaning up against the wall. I made a comment which was "do that again and see what happens" I only made this comment for them to leave me alone. the 2nd guy got in my face and said did I want to take it outside. I didn't say anything. He then lunged at me and proceeded on punching me in the face and pretty much caught me off guard.a fight ensued and I realized that he had a shiny weapon in his hand.His friend was wailing on me as well. I finally got away from them and ran out to the front and asked the clerk to call 911. The 2 guys were trying to leave so I followed them outside to get license #. I ran to my car and got my cellphone and proceeded to call 911 myself. To keep it short they cut my face in three places(one under my right eye) they ruined my suit(a Gianni versace irreplaceable very expensive one I might add), my $500 diamond studs and all my money(about $900). I didnt get all the lic. #, and was told that there was not much I could do to press charges since I made the comment, even though I was attacked with a deadly weapon and was robbed. Is the bookstore liable for any of this since it happened on their property, especially if they didn't try to help or call 911.I have permanent facial damage as well as emotional trauma. I have been in shock for the last day. can anyone help me on what my legal rights are? It took police longer than 1/2 an hour to respond, and I only stayed there for 1/2 hour at which time I went to my friends house and he helped clean me up. I was too shaken up to go to the hospital, though I have injuries. what can I do?I did file a police report in the morning when I got home from my friends.

Well, this thread certainly took a turn for the ugly.

jb, to try to answer your questions, it is unlikely the bookstore has any liablity unless you could prove they were negligent in some way. That is, that you were knowingly exposed by the store owner to a higher degree of risk to your personal safety than is typical of the type of place you were at Saturday night. While I have no personal knowledge of that type of establishment, I expect patrons have to assume a certain amount of risk when they enter, particularly at that time of night. You yourself state that this store is well know as a cruise
spot for gay men. And if it has a reputation that it's a spot for rough trade as well, then someone entering the premesis knows what risk they are taking.

Certainly the men who assualted you should be held liable. As a practical observation, not a moral judgement, wearing expensive clothes and jewelry to a porno shop in L.A. at 2am that apparenly is condusive to or even promotes sexual activity on the premesis between strangers may not be your best personal safety option. If you choose to put yourself in situations where you are at risk, sooner or later something bad is bound to happen.
