a friend of mine recieved 2 $100,000 checks from a law suite won in fla. to be nice and respectfull, he gave his parents some money to put into their personal account, paid off their car bought his mom a van ( very large and nice van), paid all the bills and bought all the groceries until they kicked him out ( they had no other income at the time ) , he also opened a joint account with his mother which did include a verbal agreement about how the money was to be spent, and finally opened his own account.
after my friend was kicked out, he started to notice money was missing and there was no account of where it went. he went to the bank to ask questions about missing bank statements and found out that there had been several withdrawals of $300 or more. he confronted his parents only to find out in the long run they were taking the money and putting it into their personal account. ever since he has wanted and tried to get the money back with out result. now he wants to sue. how should he go about it with out any money. his parents drained all his funds. we need to know what all we need to do

there are many attorneys that offer free consultations. look in yellow pages or call your local bar association.

He can also contact his area's Legal Aid Society. They are specifically set up to provide legal assistance to clients with little or no money.

If the account was held jointly with his mother I doubt he could recover the money. You could try small claims court without a lawyer depending on how much you are trying to get back. Check with the court clerk to find out the limit. Good luck

his parents took over 30,000 from him. there was a verbal contract between them about what the account was for and the verbal contract can be proven. we need to know what charges to charge them with when we file a suite or warrent.

Criminal prosecution would be done by the state. Talk to the DA. Civil action for recovery of the money would be seperate. You can often talk to an attorney for a short time for free. Go through Martindale Hubbell ( a directory of lawyers found in most public libraries) or the yellow pages and find one that handles civil litigation.

It doesn't matter if the verbal contract can be "proven". It is legally unenforceable because it violates the Statute of Frauds (amount over $500-$5000 (depending on state) and not in writing. He might have some lame breach of fiduciary duty claim, but will have to consult with a lawyer about it.
