I was awarded judgment of $4021 on July 2, 2002 through small claims court. Since the defendant has not paid I transferred the case to the civil docket so that I may start to collect. I have reviewed the wage garnishment procedures and have run into a problem...I do not know the defendant's employer or bank. I do not have money for a lawyer. Is there anything I can do on my own legally to find this out?

PS: If I go through a enforcement or recovery service, then may I collect on the fees deducted as well?

Please Help!!

Thank you!

Unless you find an unscrupulous judgment enforcement firm, they will not be able to help you with the bank information.... without actually taking ownership of the judgment. Access to a persons financial information is very limited after the passage of the G-L-B Act. This Act makes it a violation of federal statutes to even attempt to obtain an individual 'financial' records (which includes banks) by deceptive or fraudulent means. This has put a LOT of the former 'sources' out of business.

If you will FAX a copy of your judgment to me (1-208-978-6714) with your contact information, I might be able to help you to obtain this information legally.
