My response:

Make a claim with the Fair Employment and Housing Administration. An action for harassment in the workplace under the Fair Employment and Housing Act is an action for "personal injury" within the meaning of Ca Civil § 3291. [Bihun v. A T & T Information Systems, Inc. (1993) 13 Cal.App.4th 976, 1005, 16 Cal.Rptr.2d 787, 803]

Make sure you can document dates, times, places, and what was said; either or both through your own writings/notes, and/or those witnesses willing to testify for you.
