What is the name of your state? wisconsin

I am unsure where to file a small claims case. I am located in Wisconsin and the defendant is located in Florida. The dispute is a consumer transaction but no goods were delivered and no funds returned. The transaction took place over the phone. Do I file in the county where I reside or in the county where the business is located. Any advice would be appreciated.

If you want to be able to enforce the judgment against the defendant (hopefully, judgment debtor), you will need to file in his home state..... where his assets are.

My response:

You're really going to need to consult with a local "contracts" attorney on this one.

A lot depends upon the "amount in controversy" and, you have a jurisdictional situation / problem.
