Well, since you didn't mention what State you're in (and there are 50 of them with differing laws), you can check the law yourself by going to:
http://www.toolkit.cch.com/text/p05_1075.asp
Then go to the bottom of the page and click on the State you're concerned about, and it will tell you the laws for that State.
