I WORK AS A DEPARTMENT MANAGER IN A DEPARTMENT STORE. I RECENTLY TOLD AN EMPLOYEE THAT I DID NOT WANT THEM IN MY DEPARTMENT. THEY WERE OFF THE CLOCK. THIS EMPLOYEE IS IN A SECURITY POSITION. THEY HAVE BEEN ASKED BEFORE NOT TO STAND AND CHAT WITH THE OTHER EMPLOYEES. I HAD WALKED BY SEVERAL TIMES DURING THEIR CONVERSATION. I WAS BUSY AND HOPED THAT MY PRESENSE WOULD GIVE THE OTHER EMLOYEES A HINT TO GET BACK TO WORK. WHEN IT DID NOT I APPROCHED THE SECURITY EMPLOYEE AND TOLD THEM THAT I DID NOT WANT THEM IN THE DEPARTMENT. IT DISRUPTED THE OTHERS WORK. I WAS ANGRY. I DID NOT USE FOUL LANGUAGE OR COMMENTS. THE EMPLOYEE TOLD ME THAT I COULD NOT TELL HER WHAT TO DO OFF THE CLOCK AND THAT SHE COULD SUE ME. CAN SHE? WHAT ARE MY RIGHTS?

My response:

Short answer: No. On or off the clock, that person has no business disrupting another's work-in-progress. You were perfectly within your rights to tell him/her to get her/him self out of your area. Next time, just call your supervisor.
