is marriage legal?

What is the name of your state? ny. a friend was married 10 years ago to a man who apparantly was still married at the time. she has not lived with him in the past 9 years and did find out that the first marriage has ended in divorce (after she married him).now he is in jail. is her marriage legal? does she have to get a divorce or is it a void marriage? any help would be appreciated.

thank you jeter. are there any steps that have to be followed in order to prove that it is void? she tried to get her ss# back to her maiden name and they wouldn't do it.

does anyone know how to prove that this marriage is not legal. please help its very important or if someone could at least point us in the right direction

Find out what county and state the first marriage allegedly took place. Scour the courthouse records to find the evidence of a marriage license being issued. Then investigate for a possible divorce decree on record.
