We recently made an offer of employment to an attorney, which he accepted. Today,upon speaking to the attorney's former employer, we found out information as to the work product of the attorney that, had we know, we would not have made the offer. Can we now legally withdraw our offer of employment, rather than have this person employed for a trial period and then let go?

My response:

You put the cart before the horse on this one. Now, you're stuck. The new attorney could make a claim against you for Breach of Contract, Detrimental Reliance, and Libel. If you asked more questions of his former employer beyond: Term of Employment, Pay Rate, and mere confirmation of employment, both you and the former employer may be in for a rude awakening.
