What is the name of your state? Colorado, I filed for divorce in colorado, as a resident, and we already have a hearing date set. All the required information was sent to the other party. In an attemp to "get out" of coming to the hearing, she has filed in California. Can she do that or is it the place that the divorce was first filed, that the court hearings will be held?

My response:

You're going to have to file a Motion to Dismiss in the California action, attaching CERTIFIED COPIES of your Colorado Petition. The California court will dismiss her Petition.
