My employer has announced that our office will be closing. All employees have been offered similar positions at a new facility the employer has built about 45 miles from the old facility. Severance packages are being offered but only to people who's homes are a distance of greater than 50 miles from the new facility. I, however,live only 45 miles away and have been told that severance is, for that reason, not an option. I have been with the company quite a while so the package could be quite attractive were I eligible. This seems to me to be discriminatory because I am being denied a benefit that is being offerred to many of my colleagues just because my home is located on the wrong side of an arbitrarily drawn line. Can I challenge this legally? Thus far I have received only verbal notification and am told written notice will be forthcoming. What if I simply moved five miles down the road before I am officially notified? I work in California.
