a store claims they have a person on video stealing. person is
arrested. store claims tape has been retaped over, but did have an officer veiw it before hand. Legal?

**A: yes, it is legal for the officer to view the tape and testify as to what he saw. The store should have taken the tape out of use and held it as evidence.

Very weak evidence if the store decides to press charges. A competent defense attorney can have a field day with the tape that no one saw except an officer.
