I moved to California almost 2 years ago to work for an Indian Casino. I moved 2,900 miles for this job on what was promised to me, as well as others in my position at the time we were offered the job. However, after a few management changes, none of us have received anything we were promised and our situation is getting worse everyday and we are being used and abused and told that if we dont like it we can go to work somewhere else. We are not earning what we were told we would be earning and we are not getting anything we were told we would get in consideration of our positions.

Frankly, I know nothing about legal matters with American Indians involved but I would like to know if there is any sort of legal action I can take for the time I have lost away from my friends and family and the money I have not received that I should have and the interest on that money. There are at least 4 of us in this position, maybe more, that were all offered the same things and none of us have gotten any of it. I appreciate any help or advice.

Unless your offer of employment constituted a bonafide employment contract or you can prove that the employer knowingly defrauded you during the recruiting phase in order to induce you to accept the job, it is very unlikely you have any legal recourse. The changes in management you mention undoubtedly explain what has taken place and it is unlikely they have any obligation to follow through on statements the previous management made.

If the casino is located on a reservation, you will definitely need to talk, not just to an attorney, but one who is knowledgeable about Native American law. Reservations are in many cases considered sovereign nations and employment law that is valid elsewhere in the US does not apply there.
