What is the name of your state? NY
I was wondering, if an ex-employee (by no fault of their own) was slightly overpaid must they return the excess portion of their pay after they do not work there any more? Also, what if they do not have the money any more? I would just like to know what the legal rights are that the employee has, if any? Thanks.

I'm a Northern Girl
If any employee, current or former, receives money that they were not entitled to, they are obligated to return it regardless of whose error it was. It would be better to do it of your own accord rather than to wait and have the company sue you for it.
