An election as been ordered to determine which employee organization will represent the majority of our bargaining unit. The present representative says if the other side wins our contract will become void at that time. The other side says, the present contract will continue until they can ratify a contract of their own, because it sets working conditions. The present terms of agreement seem to be a little vague to me. Can you please help me understand better?
The present contract terms of agreement reads:
38-1
This Agreement shall remain in effect until the 30th day of June 2003 and shall continue from year to year thereafter. In the event the parties commence negotiations for a successor agreement, then this Agreement shall remain in full force and effect until such successor agreement is ratified.
38-2
This Agreement shall immediately terminate in the event recognition is withdrawn and sustained after all avenues of appeal have been exhausted in accordance with NRS.
