My husband was employed as a director of development. He and his boss did not get along and he was given the choice to resign or be fired. He chose to resign.

He had a 1 year contract that he fulfilled and was not offered an additional contract, it ended in July. The terms were that part of his salary/bonus was based on the amount he raised. After he was already working there and had a signed contract stating the terms of how the bonus would be paid, his boss informed him that several of the fundraisers done in the past would not count toward this goal. He never specified this in writing or on a revised contract.

The terms of the bonus were that: after he raised $x he would receive $15,000 of the next monies raised, also to include 10% of all monies raised after that.

The total money raised for the year was well over the $x and we believe that he is owed approximately $22,000. His boss does not believe he is owed anything because he told him that several of the fundraisers did not count toward his bonus goal - it was never in writing though and truly my husband would have never agreed to taking the job in the first place if he had known that - but by the time he told him, he was already working there and didn't want to loose his job.

Do you think we have a legal case?

Your husband really is going to need to see an attorney to get his question answered - this is a contract issue, not an employment law issue. The answer will most probably lie in the exact wording of the employment contract your husband and his former employer entered into.
