When applying for a job, does the prospective employer need to receive your permission(written) in order to conduct a criminal background check?

As the applicant, do you have the right to see a criminal report that was furnished to a prospective employer? If so, who would I contact to receive - the employer or the company supplying the report?

The law you need to research is the Fair Credit Reporting Act (FCRA.) Among other things, it addresses your rights if the employer uses an outside agency to conduct background checks. Basically however, if the employer does such checking themselves, your permission is not required and they do not have to reveal that they conducted such a check or what the results were.

These days, much of this information is almost immediately accessible over the internet.
