What is the name of your state? Texas
What kind of information can keep a prospective employer from not hiring you? If you were arrested, charges dropped, & the arrest expunged from your record? If you were forced to resign at another company due to educational discrepicies found during the background check? Can either of these issues keep them from hiring you if these questions were never ask?

Yes, either or both of those situations can keep a prospective employer from hiring you, whether they asked about those things in an interview or not.

An employer may use any information or opinion to not hire somebody except for those things that are specifically prohibited: age, race, religion, gender, national origin, disability (in some cases), veteran status, pregnancy and sometimes a few other things at the State level. Occasionally that includes criminal record, depending upon the crime and the State. What is not protected is lying about your criminal record or anything else duriing the recruitng process.

An employer can decide not to hire you because they don't like the way you part your hair or because you wore a plaid shirt, although it's very unlikely an employer would be so frivolous.
