What is the name of your state? SC
A person is convicted of a crime and pays the fine. The warrant officer tells the person that once the fine is paid, this offense will not be on his permanent record. Is it the warrant officers duty to let the person know that a petition for expunction must be filed? If the person applied for a job and did not disclose this conviction (thinking that it is not on his record), is this considered falsificaiton of application?

It can be. It was the responsibility of the person to determine beforehand whether it was or was not on his record, not to just assume it.

but the convicted person viewed his warrant officer as trustworthy. there was no intent to do something wrong. do you think not disclosing the conviction "in this case" on an employment application is reason for termination?

FYI, junebug, there are a fair number of posts here from folks who were denied employment or terminated for falsifying their applications for the circumstances you cite - a criminal conviction record they believed was expunged.

All I can tell you is that an employment application typically asks "Have you ever been convicted of a crime?" Not "Have you ever been convicted of a crime except for those things that were supposed to have been expunged and weren't?"
