Father's rights

What is the name of your state? Utah


A child is born due to an extramarital affair, both parties are already married. The biological mother is keeping the child but the biological father wants the child to be given up for adoption, he feels it is in the best interest of the child. What are the fathers rights in this situation?

Are you asking if bio dad can force bio mom to adopt out the child if she doesn't want to? Nope.

However, if he wants a relationship with the child, then he'll have to file a petition to establish paternity. My guess is a lot of hell will be raised for TWO couples and their other kids, if any -- and a paternity test will be desired by someone in the equation.

Once paternity is established, child support and visitation also can be established.

Or all of them can pretend that nothing happened and let bio mom and her husband raise the child as their own -- and bio dad can hope that he doesn't get a call in the middle of the night and have to explain to his wife what happened a few years ago because bio mom's marriage imploded and she now wants financial support for bio dad's child.
