adoption and paid leave of absence

For a single mom buddy of ours.

She adopted her first child, internationally, in 2001. This country required travel to them and that took two weeks time before arriving home with her child.

Employer (small medical practice) gave her six weeks paid time off. Just like other moms for this employer, that would be biologically having a baby. They get six weeks paid maternity leave.


This mom is now adopting another child. Same international country, requiring a two week trip to get child.

Told employer in September about plans to adopt another child.

Leaving work next week, traveling right after Thanksgiving weekend, for this second adoption.

Employer says, we are in a financial bind, we have to hire someone to take over your duties while you are gone and we can't give you any paid leave. They told her to take the FMLA, and your two weeks vacation will be paid. But, no six weeks paid like last year.

Other women in office, having children biologically, are still being given six weeks paid leave by the employer.

Seems, since a small company/practice, there is nothing in writing anywhere. Even if there was, it would most likely be for "paid leave for maternity leave................" and not adoption, like many employers.

Anything this woman can do or say to try to convince employer that she should also get paid time off?

Was it wrong for her to assume, since the employer gave six weeks last year, under the exact same circumstances, that it was reasonable for her to expect to get that again this year?
