as part of my divorce, the debt was split, and now my ex is not paying his portion, which is with a debt management company, also in my name. they are not trying to get me to pay by force or anything (we are communicating), however he continues to be late, and i wonder if it is better to pay it myself and go to small claims court over it, or let my credit take the hit for his tardiness? it's between 300-350 dollars right now. i'm concerned i may not get my money back if i pay it. he does have a home and i believe he is working, so can they garnish wages with a small claims court decision? is it worth the hassle to pay it to save my credit, or do the late notes not look as bad as i think?
