My mom was in a auto accident in Aug 2002. I know there is a time limit.

Is it one year to settle a claim and get paid or is it one year to file a law suit in court.

My response:

You have up to 1 year to file your lawsuit for personal injuries, and 3 years for property damages. Although, it's proper to file both for both claims in a single lawsuit prior to the 1 year S.O.L. Your Mom's S.O.L., therefore, would be August ____, 2003.

Where is her attorney in this matter? Attorneys, despite their fee, often are able to obtain far larger settlements than the average person who attempts to represent themselves in negotiations.
