deal with ins. co or towing co?

Our ins. co. sent a towing co. to p/u our vehicle that they considered 'totaled'. We signed the title over to them. They already took us for several thousand dollars on the vehicle since they have their own value guides. Anyway the towing company caused damage to our gate and post when they came. I told them not to pull in the drive but they did it anyway. Told them I would drive the car to the rd. but they didn't listen. They drove semi-truck over septic and hit gate on way out. Septic not damaged but we want gate fixed. Our son opened gate the other day and it fell on him on his face. We have to have gate otherwise cows will get out onto rd.

Ins. co is trying to get us to deal w/towing co. Want US to take the photos and deal directly with towing co. We didn't hire towing co, call them to p/u vehicle, nothing. We have already been ripped off by ins. co and now twice.
What can we do? Do we have to deal with towing co?

What should you do? Make sure you change your insurance company for one IMHO. Plus, and it's a moot issue for you (but maybe not for other readers) -- you know you don't have to accept what the insurance company offers in the way of property damage money. They appear like they won't negotiate, but nearly all things are negotiable..... There are many resources on the Net, including this web site, regarding how to negotiate, the styles or 'steps' of negotiation and what you need to do to negotiate successfully. Just use the Search button or use the FAQs on this site. You might also choose to go to www.google.com or www.webcrawler.com (or other web search engine) and use keywords that suit your search.

Also, it seems that you will have to deal with the towing company and present your evidence, or sue them in small claims court or tell them you will call an attorney who will file a complaint, which may make them act -- and tell them you will ask for not only what you are seeking now for repairs but they will be liable for any court/attorney's fees.

Then be willing to file suit if need be. The bad thing about this is that it will take time, so you will have to have patience and by then your anger may go soft-er.... or not.
