back in 1996 i lived with a man and assumed his last name as if we were married (common law) but he was married to someone else legally
i used his last name on a lease and at a job i worked at
i am wanting to get married now
would i still have to go through legal divorce proceedings in this case or would that common law marriage not be valid

since he was still legally married to another woman there was no legal marriage to you.
