What is the name of your state? NC


A friend recieved a package from UPS and the person signed for the package (awaiting car parts for older hot rod). About 5 minutes later the police crash the front door,which was a glass screen door OPEN, and to make a long story not so long the package (which never got opened & was underneath the coffee table in the living room in plane sight) supposedly had 28+ grams of meth. They ended up charging this person w/traff. & consp. to traff. more than 28 but less than 200 grams of meth. And the person that was also named in the conspiracy CHG was not the person that was on the return label. The search warrant states that a k-9 had HIT on the package and that justified them opening and searching the contents.(if it matters the k-9 that suppsedly HIT on the package is trained to detect Marijuana,Cocaine,Heroin.) :confused:

No, it makes no difference at all that the K9 was a heroin sniffer. He could have been a butt sniffer. He is member of the drug enforcement team and anything that K9 says, goes. That unopened package didn't "supposedly" have meth in it -- it had more than 28 and less than 200 grams of meth in it. You're dealing with idiots who ship meth via US postal and put bogus names on the return address and then want to think about dissecting the search warrant for a way out. There is NO WAY OUT. Busted. Out and over. Over and out.

From a law enforcement standpoint a "hit" from a k-9 dog is probable cause for search or at least probable cause for a search warrant.

And was your 'friends' name on the 'ship to' label?? If so, how do you imagine that these 'bad guys' wherever they are located, managed to find HIS name and address?? Do you think that THEY made an addressing label and meant to deliver 'something else' (maybe heroin instead of meth)??

Do you really think that we were born last night??

If the person who sent it put a false name on the return address and he was still found and arrested that means that there was some kind of investigation already going on. Someone got popped for something else and gave them up or whatever but the cops obviously knew something. Either through investigation or informants.
Is UPS the United Parcel Service or is UPS the United States Postal Service? I read it to mean the first one.

I guess another question would be how do they come to charge this person with Traffiking if they never caught the person dealing?

Somewhere, somehow, someone has gotten enough evidence fo formally charge this person with trafficking and conspiracy. People who get busted and/or indicted on charges do not necessarily have to be caught red-handed in the act. It's called undercover sting operations. Do you know how smart traffickers are? Well, their smarts teach our feds how to be smarter. Do you honestly think that package of meth had nothing to do with your friend? Do you honestly think they busted down the door if they weren't certain? It doesn't happen that way. Your friend is hot -- red hot.

I have personally been involved in undercover narcotics operations that lasted for several months. We might buy from the same dealer several times over several months. This helps in confusing the dealer. You can see their little gears smoking in their heads at the time of their arrest trying to figure out who they sold to that got them busted. Every purchase serves to substantiate the probable cause.
What they don't realize is that the undercover informant or agent may have bought from him/her several months prior to that. They just hold the warrant until the right time.

To Hgrego: I've always thought it would be SO "adrenalin" to work undercover with a narcotics unit. A job I'd never be late for, for certain! I can't imagine what it would actually be like infiltrating these people's lives and their places, being one of them, doing the deeds for a while and all the while taking them down. You guys do a thankless job. Thanks anyhow!
