What is the name of your state? Ohio
My separation agreement states that "the husband will have no contact with the child".....does that give me custody until the divorce goes thru?

Technically, yes... but legally no.
The agreement, unless a court order, is only binding if it meets the law.... and a one-sided agreement without benefit to BOTH parties, won't stand.

This agreement will be signed by both of us in court with his attorney present.......This will be in place of a protection order.....I want to keep the baby safe from him.....and he agrees to stay away.
