My wife and I are selling our current home, we have been seperated for four months and she has no desire to come home. We have not discussed the split but Iam assuming it will be fifty/fifty. My question is; I am going to buy another house with my share of the proceeds, will she have any rights or claims to the house I purchase.

Consider renting until the divorce is final to avoid possible pitfalls.

she needs to go to the title company before you close on the new home and sign a "Quit Claim" form. if she is willing...otherwise wait to buy.
