My new husband had a credit check done in order for us to purchase a new home. However we found on his credit that he and his ex wife had several unpaid collection agencies and bills. They have been divorced for 2 yrs now and we are willing to pay for their mistakes in order to purchase a house for us. But I am 100% sure she will not want to pay for any of this even though its on her credit as well because she dont care about her credit. IM not saying for her to pay half of it for "us" but you would think she would want to pay those off because of her own credit, her new b'f and new baby. Im thinking she isnt under any obligation to pay any part of this since it's her credit and her decision but since she helped him destroy it should she have to pay half to get it restored for both their sakes?

With joint credit, both parties and jointly liable for the debt. If one party declines to pay, the creditor can come after the other for payment. This is the reason that the adverse credit appears on both your husband's and his ex's credit report.

In this situation, the creditor or collection agent does not really care who pays, just that someone pays. And, unfortunately, in your case, if you want the house badly enough, you folks will be the ones to pay the entire debt off. If your husband wants to persue the ex for repayment of half of the debt, he can attempt to do that. However, creditors do not "split" the debt 50/50 with jointly acquired credit.

It wasnt really credit. What happened was WE got a credit report done and found on there that HIS EX WIFE went to the DR after having a baby and apparently used his name as the responsible party for the bill etc. This was in July of 2001 and they had been divorced since Sept 2000. That is why I was wondering if we contact the Dr she went to which was ab obgyn and get things faxed or mailed to us that it was her that was in the DR office isnt she the one suppose to pay that bill? AND Isnt it against the law for her to put his name down to be the one financially responsible when they were legally divorced and she is w/ someone else and has someone else's kid? I dont know Im just real confused at this point and dont understand why we should pay her DR bill because she put his name on the bill and it ended up on his credit report.......

You have to send them a validation letter. Briefly explain the situation & ask them for copies of your husbands signature as payor. Of course they can't validate, so it will drop off. There are a few templets for this on the internet (it's pretty common, & YES, it is FRAUD). If you know her knew address, feel free to include that as well...just for *grins*. *LOL* You'd do much better posting this on the credit/collection forum. We had also had this problem, validate, it WORKS.
