What is the name of your state? california
my daughter was arrested in the court house for h&s 11550 under the influence no blood or urine test done can she be charged for that solely on the officer stated that he thought she was under the influence she was arrested and booked but she didn't understand her rights can this charge stick.

It can "stick" if she admitted it. Just because she was under the influence would not mean she did not understand her rights. If that were the case, everyone in jail would be walking free. Why didnt' she understand them?
