I got married last year and adopted my stepson. He is recognized as a special needs child by the state of Indiana. Are we eligible for the adoption credit? Can I be eligible if we file separately. Thank you for your time.
You can't take the adoption credit if you file married separate. You cannot take the adoption credit for adopting a spouse's child, regardless of whether the child is a special needs child.
