Whether a person is guilty of simple possession or possession for sale depends on the circumstances, not on the amount. You can be found guilty of possession for sale if you are caught with even a very small amount if the police also find other evidence suggesting sales, such as scales, baggies, cash. Large quantities of drugs also suggest sales, particularly when the prosecutor gets an officer to testify that most users do not buy in bulk.
