What is the name of your state? Arizona

My ex-husband has not filed his Federal and State Taxes for about 5-6 years. He is presently in prison for DUI offense and is serving about 3-4 years, he has been gone for about two years now and mail from the IRS is rolling in, what should he do regarding his taxes or what can I do to protect him from serving any more time?

Another Questions; He is a construction worker and companies that he has worked for in the past, i believe did not take enought taxes from his check, who's responsibility is it to pay these taxes?

he should collect the W-2s & file the tax returns. If the IRS does it for him, they may not take all the deductions to which he was entitled. If he owes income taxes, he'll have to pay them eventually. If the employers messed up the payroll taxes, they have to fix it.
