What is the name of your state? virginia, i need to know what the last day that an employer can send w-2 forms and what i should do about an employer who hasnt sent them by that time? should i file without it? should i contact a lawyer? this is in regards to an employer who for the past 3 years has waited as late as april 14 to give me my w-2. i want to know what legal action i can take so i can file my taxes in a proper manner.

Employer has until 1/31 to send out the W-2. If s/he doesn't, you can file using a substitute W-2 and the information on your last paycheck stub. You file a substitute W-2, form 4852. You can also file a complaint with the IRS that this guy is not meeting his deadline. Maybe they will fine him.
