My soon to be ex and I are in the process of a divorce... We have papers drawn up that say I get to claim one child and he claims the other.. He left in may and I dod not recieve one PENNY of support from him. He doesnt even watch them when he is supposed to. They have lived with mje and I HAVE SUPPORTED THEM!!!!
Well he just infomred me that he filed his taxes and he claimed both kids...
What rights do I have??? OR recourse do I have????
We are going to court to day for custody and support. Can I request that I get that check???

If you both signed an agreement that you each get one child, you're stuck. If you only had a tentative or verbal agreement, the custodial parent (you) can claim both kids. As the custodial parent, you can file as head of household if you did not live with him after July 1, 2002. If you should get the exemption, file with the kid(s) and include an explanation that they lived with you & ou are the parent entitled to claim them under the tax code. The IRS will review the returns & take money away from him. Be sure the kids' school & medical records list your address as the kids' address.

For the court hearing, request that him claiming any child be contingent on his being paid in full on his child support by 12/31 each year.
