What is the name of your state? california
my mom passed away years ago,1981 and they had a will and a testementry trust was created and the assets were half to the trust and half to survivor the trust tax form 1041 has been filed since then every year! My dad had a living trust made a few years after mom died in 1995 me as co trustee and now he is in bad health , when he dies his taxable estate is everything he owns which is 3 properties etc. are these figured as half of the present value since the other half was settled under the testementary trust when mom died?
